Terms of sale

1. Scope

These general terms and conditions of sale (terms of sale) apply to all orders placed by consumers on the BabyBeasties website. By confirming an order, you declare that you have read and accepted them. The terms of sale that apply are those in force on the date of your order.

2. Seller

Products are sold by Naïl BOUMENDJEL (EI), a French micro-enterprise trading as BabyBeasties, 12 Rue De Venise, 69100 Villeurbanne, France, SIRET 945 274 975 00016, email bmd.ecom691@gmail.com. All details are available in our legal notice.

3. Products

The essential characteristics of each product are presented on its product page. Photos and videos are as accurate as possible but may show slight differences (colour, look of the materials); some lifestyle photos and videos are created with artificial intelligence tools. A size guide is available on the product page: if you are between two sizes, we recommend the larger one.

Our onesies are costumes made for play, dressing up and photos, to be used under adult supervision. The padded shell is not suitable for sleep.

4. Prices

Prices are shown in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. For orders delivered outside the European Union, prices may be displayed in your local currency, converted at the current exchange rate, and customs duties or local taxes may be due on delivery (see our shipping policy). Any shipping costs are shown before you confirm your order. The applicable price is the one displayed when you place your order.

5. Ordering

You choose your items, add them to your cart, enter your details and delivery address, choose your shipping and payment method, then confirm your order. A confirmation email summarising your order is sent to you. We may refuse or cancel an order in the event of a payment problem, an incomplete address or a previous dispute, and will let you know if so.

6. Payment

Payment is made online when you place your order, using the methods offered at checkout (bank card and other methods shown). Payment is processed securely by our payment providers: we never have access to your full card details.

7. Delivery

Delivery areas, rates and estimated times are detailed in our shipping policy. A tracking number is emailed to you as soon as your order ships. If your parcel arrives damaged or incomplete, let us know as soon as possible with photos at bmd.ecom691@gmail.com: we will find a solution at no cost to you.

8. Right of withdrawal

You have 14 days from receipt of your order to exercise your right of withdrawal, without having to give any reason. Return costs are at your expense, unless the item is defective or does not match your order. We will refund you no later than 14 days after being informed of your decision; we may withhold the refund until we have received the item back or until you have supplied proof of having sent it back. The procedure and the model withdrawal form are available in our returns policy.

9. Legal guarantees

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience. The consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if: the seller refuses to repair or replace the goods; the repair or replacement takes place after thirty days; the repair or replacement causes major inconvenience to the consumer; or the lack of conformity persists despite the seller's unsuccessful attempt to remedy it. The consumer is also entitled to a price reduction or to terminate the contract when the lack of conformity is so serious that it justifies immediate action, without first having to request repair or replacement. The consumer is not entitled to terminate the sale if the lack of conformity is minor. Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period.

These rights arise from articles L.217-1 to L.217-32 of the French Consumer Code. A seller who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L.242-18-1 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code) for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

10. Liability

We cannot be held liable for damage resulting from use of the products that does not comply with their intended purpose or with the instructions for use and care provided. We cannot be held liable in the event of force majeure or the act of a third party.

11. Personal data

The data collected when you order is needed to process it. It is processed in accordance with our privacy policy.

13. Mediation

If a dispute cannot be resolved with our customer service, you can refer it free of charge to the consumer mediator: [À COMPLÉTER : nom, adresse et site internet du médiateur].

14. Governing law

These terms of sale are governed by French law. If you live in another European Union country, you keep the protection granted to you by the mandatory provisions of the law of your country of residence. In the event of a dispute, and failing an amicable settlement, the competent courts are those designated by law.

This English version is provided for convenience. In case of discrepancy, the French version prevails.
